Terms of service

1. Acceptance of terms

By subscribing to our services, you certify that you are of legal age and have the legal capacity to contract. Lys Hosting reserves the right to modify these terms; material changes are announced to clients before they take effect.

2. Acceptable use policy (AUP)

Our services must be used for lawful purposes only. The following are strictly prohibited:

• hosting illegal content (child sexual abuse material, incitement to hatred, etc.);
• sending unsolicited email (spam);
• hacking activities, port scanning or denial-of-service attacks;
• abusive use of resources (CPU, memory) to the detriment of other clients.

3. Abuse policy

Any abuse complaint is investigated immediately. We reserve the right to suspend or terminate any service that violates our policies, without notice or refund in serious cases.

4. Payment and billing

Services are billed in advance, at the listed price — identical at renewal. Non-payment results in automatic service suspension after a 5-day grace period. Hosting plans have no commitment and include a 30-day satisfaction guarantee.

5. Backups and limitation of liability

We perform daily encrypted backups, stored off-site (retention: 7 daily, 4 weekly, 6 monthly), and we test restorations periodically under an internal procedure. Final responsibility for keeping a copy of one’s data nevertheless remains with the client. Lys Hosting is not liable for revenue losses resulting from a service interruption; applicable compensation is that provided in our service level agreement (SLA).

6. Data location

Client website data is hosted in Canada, on our Montreal infrastructure. Backup copies are encrypted before transfer and the storage provider does not hold our decryption keys. Some auxiliary services (DNS servers, monitoring) use international points of presence. Details are in our privacy policy.

7. Governing law and jurisdiction

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Any dispute will be submitted to the exclusive jurisdiction of the courts of the district of Montreal.
